Ambassador Program Terms
Last Updated: May 9, 2026These Ambassador Program Terms ("Program Terms") govern your participation in the Habits Collegiate Ambassador Program (the "Program"), operated by Habits365Greek LLC, DBA Habits Collegiate ("Company," "we," "us," or "our").By submitting an application, accepting a position as an ambassador, or participating in the Program in any way, you ("Ambassador" or "you") agree to these Program Terms, our [Terms of Service](https://habitscollegiate.com/policies/terms-of-service), and our [Privacy Policy](https://habitscollegiate.com/policies/privacy-policy).

- Be at least 18 years old
- Be currently enrolled as a student at a college or university
- Maintain an active, public Instagram and/or TikTok account
- Have a U.S. shipping address and be eligible to receive payments in the United States
- Comply with all applicable federal, state, and local laws, including FTC endorsement disclosure requirements
- Comply with all applicable rules of your school, sorority, fraternity, or any other organization you are affiliated with
NCAA, NAIA, and NJCAA Student-Athletes: Due to the rules of our collegiate licensing agreements, the Program is not open to current student-athletes participating in NCAA, NAIA, or NJCAA varsity athletics. If you are a student-athlete and interested in working with Habits Collegiate, please contact us separately at [sales@habitscollegiate.com] to discuss compliance with your school's NIL (Name, Image, and Likeness) policies.

The Program is not affiliated with, endorsed by, or sponsored by any university, college, sorority, fraternity, or other licensor. As an Ambassador, you represent the Habits Collegiate brand only — not your school or any other organization.You may not represent or imply that any school, sorority, fraternity, or other organization endorses, sponsors, or is affiliated with the Program or with you in your capacity as an Ambassador.

- A unique discount code that gives followers a discount on Habits Collegiate purchases
- Commission on every sale made through your unique tracking link or discount code, at the rate communicated to you upon acceptance into the Program
- Access to occasional product gifts, early access to new releases, and other perks at our discretion
Commissions are tracked through our ambassador platform. Payouts are made on a regular schedule communicated during onboarding, subject to a minimum payout threshold. We may withhold or reverse commissions in cases of fraud, returned orders, or violations of these Program Terms.You are responsible for any taxes owed on commissions or compensation received through the Program. Where required, we may issue you a Form 1099 or similar tax document.You are an independent contractor, not an employee, agent, partner, or joint venturer of Habits Collegiate. You have no authority to bind or represent the Company.

- Post content featuring Habits Collegiate products on your social media channels on a regular basis (frequency to be communicated during onboarding)
- Disclose your relationship with Habits Collegiate clearly and conspicuously in any post promoting our products, in compliance with FTC endorsement guidelines (e.g., using #ad, #sponsored, or "Paid partnership with @habitscollegiate")
- Use only authentic content — content you created or have full rights to use
- Represent the brand professionally and consistent with our brand guidelines
- Refrain from posting content that is offensive, discriminatory, defamatory, sexually explicit, or that promotes illegal activity, hate speech, violence, or substance abuse
- Refrain from making false or misleading claims about Habits Collegiate, our products, or our pricing
- Comply with all applicable laws and platform terms (Instagram, TikTok, etc.)
- Not use paid advertising to promote Habits Collegiate without our prior written approval
- Not bid on Habits Collegiate brand terms in search engines or marketplaces

Content RightsWhen you post, tag us in, or submit content as part of the Program, you grant Habits365Greek LLC a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, distribute, display, and repurpose that content across our marketing channels, including but not limited to:
- Our website
- Our social media accounts
- Our email and SMS marketing
- Paid advertising on Meta, TikTok, Google, and other platforms
- Print materials, lookbooks, and brand campaigns
We will provide attribution where appropriate. You represent and warrant that you own or have all necessary rights to any content you submit or post, and that the content does not infringe the rights of any third party (including any individuals depicted in the content).

Use of the Habits Collegiate BrandWe grant you a limited, revocable, non-exclusive license to use the Habits Collegiate name and logo solely for the purpose of promoting Habits Collegiate products as part of the Program. This license terminates immediately upon termination of your participation in the Program.You may not:

- Modify our logo, brand assets, or product imagery without permission
- Create or sell merchandise bearing the Habits Collegiate name or logo
- Use the Habits Collegiate brand in any way that could damage our reputation
8. Discount Codes and Tracking LinksYour unique discount code and tracking link are personal to you and may not be:
- Sold, transferred, or shared on coupon aggregator websites
- Used for fraudulent transactions, including self-referrals or transactions made by people you live with where the primary purpose is to earn commission rather than legitimate purchase
- Combined with other promotional offers unless explicitly authorized
We reserve the right to monitor for misuse and to withhold or reverse commissions and terminate your participation in the Program for violations.
9. Term and TerminationYour participation in the Program continues until either you or we terminate it. We may terminate your participation at any time, with or without cause and with or without notice, including for:

- Violation of these Program Terms, our Terms of Service, or any other agreement
- Conduct that damages or could damage the reputation of Habits Collegiate
- Inactivity or failure to meet posting requirements
- Fraud, misrepresentation, or misuse of your discount code or tracking link
- Loss of eligibility (e.g., no longer a college student)
You may terminate your participation at any time by emailing us at [sales@habitscollegiate.com]Upon termination, your discount code and tracking link will be deactivated, and any unpaid commissions earned in compliance with these Program Terms will be paid out at the next regular payout cycle. Any commissions earned through fraud or violations of these Program Terms may be forfeited.
10. FTC Disclosure RequirementsThe U.S. Federal Trade Commission requires that endorsers disclose material connections (such as receiving free products, commissions, or other compensation) when promoting brands. As an Ambassador, you agree to:

- Clearly and conspicuously disclose your relationship with Habits Collegiate in every post promoting our brand or products
- Use clear language such as "#ad," "#sponsored," "Paid partnership," or "Habits Collegiate Ambassador"
- Place disclosures in a location where they are easily noticed (not buried in hashtags or below "more" links)
- Comply with all FTC Endorsement Guides and platform-specific disclosure requirements
Failure to comply with disclosure requirements may result in immediate termination from the Program and could expose you to personal liability under FTC rules.

ConfidentialityYou may receive confidential information from us in connection with the Program, including upcoming product launches, pricing strategies, marketing plans, and other Ambassadors' information. You agree to keep this information confidential and not to disclose it to any third party without our prior written consent.
12. Disclaimer and Limitation of LiabilityTHE PROGRAM IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE ANY SPECIFIC LEVEL OF EARNINGS, FOLLOWERS, ENGAGEMENT, OR OTHER OUTCOMES FROM PARTICIPATION IN THE PROGRAM.TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU IN CONNECTION WITH THE PROGRAM SHALL NOT EXCEED THE TOTAL COMMISSIONS PAID TO YOU IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

WE DO NOT GUARANTEE ANY SPECIFIC LEVEL OF EARNINGS, FOLLOWERS, ENGAGEMENT, OR OTHER OUTCOMES FROM PARTICIPATION IN THE PROGRAM.TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU IN CONNECTION WITH THE PROGRAM SHALL NOT EXCEED THE TOTAL COMMISSIONS PAID TO YOU IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

- Your participation in the Program
- Your content (including any claims of intellectual property infringement, defamation, or violation of privacy rights)
- Your failure to comply with FTC disclosure requirements or other applicable laws
- Your violation of these Program Terms or any third-party rights
14. Governing Law and Dispute ResolutionThese Program Terms are governed by the laws of the State of Connecticut, without regard to its conflict of laws principles. Any dispute arising out of or related to these Program Terms shall be resolved through binding individual arbitration in Connecticut, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
15. Changes to These Program TermsWe may update these Program Terms from time to time. When we do, we will revise the "Last Updated" date and notify Ambassadors via email. Your continued participation in the Program after changes are posted constitutes acceptance of the revised Program Terms.
